The two departments announced the catalogue of goods subject to export license management in 2019.

According to the Foreign Trade Law of People’s Republic of China (PRC), Regulations on the Administration of Import and Export of Goods in People’s Republic of China (PRC), Regulations on the Administration of Substances that Deplete the Ozone Layer and other laws, administrative regulations and relevant rules, the Catalogue of Goods Subject to Export License in 2019 (hereinafter referred to as the Catalogue) is hereby promulgated, and the relevant matters are announced as follows:

1. Foreign trade operators of goods listed in the export catalogue shall apply to the Ministry of Commerce or the local competent commerce department entrusted by the Ministry of Commerce for obtaining the Export License of People’s Republic of China (PRC) (hereinafter referred to as the Export License), and go through the formalities of customs declaration and clearance with the export license.

(1) Foreign trade operators export live cattle (exported to Hong Kong and Macao), live pigs (exported to Hong Kong and Macao), live chickens (exported to Hong Kong), wheat, corn, rice, wheat flour, corn flour, rice flour, medicinal ephedra (planted artificially), coal, crude oil, refined oil (excluding lubricating oil, grease and lubricating oil base oil), sawn timber and cotton. Those who export licorice and licorice products, rush and rush products shall apply for an export license on the strength of the bid-winning documents of quota bidding.

Where the goods listed in this paragraph are exported in the form of processing trade, an export license shall be applied for on the basis of quota documents and goods export contracts. Among them, the export of licorice and licorice products, rush and rush products, with the quota bidding documents, customs processing trade import declaration form to apply for export licenses.

(2) Foreign trade operators export live cattle (to markets outside Hong Kong and Macao), live pigs (to markets outside Hong Kong and Macao), live chickens (to markets outside Hong Kong), beef, pork, chicken, natural sand (including standard sand), bauxite, phosphate rock, magnesia, pumice (powder), fluorite (fluorspar), rare earth, tin and tin products, tungsten and tungsten. Some metals and products, disodium sulfate, silicon carbide, ozone-depleting substances, citric acid, vitamin C, industrial salt of penicillin, silver, platinum (exported by processing trade), indium and indium products, motorcycles (including all-terrain vehicles) and their engines and frames, automobiles (including complete sets of spare parts) and their chassis, etc., need to apply for export licenses according to regulations. Among them, the sample advertisements of ozone-depleting substances need to be exported with export licenses. To export automobile and motorcycle products by general trade, processing trade, border trade and donation trade, it is necessary to apply for an export license according to the prescribed conditions; Where automobile and motorcycle products are exported by way of project contracting, an export license shall be applied for with the winning bid documents and other materials. Those who export automobile and motorcycle products that are not originated in China by the above-mentioned trade methods shall apply for export licenses on the basis of import customs documents and goods export contracts.

Where the goods listed in this paragraph are exported by way of processing trade, unless otherwise stipulated, an export license shall be applied for by the relevant approval documents, the customs import declaration form for processing trade and the goods export contract. Among them, to apply for the export license of refined oil such as lubricating oil, lubricating grease and lubricating oil base oil, an application letter from the provincial competent commercial department is required; Exporting refined oil other than lubricating oil, lubricating grease and lubricating oil base oil is exempt from applying for an export license.

(3) Where a foreign trade operator exports the goods listed in the first paragraph in the form of small-scale border trade, the provincial local commerce department shall issue an export license according to the quota and requirements of small-scale border trade issued by the Ministry of Commerce. Exporting licorice and licorice products, rush and rush products, ozone-depleting substances, motorcycles (including all-terrain vehicles) and their engines and frames, automobiles (including complete sets of spare parts) and their chassis and other goods by means of small-scale border trade shall apply for export licenses in accordance with regulations. Exporting goods listed in the catalogue other than the above circumstances in this paragraph by means of small-scale border trade is exempt from applying for an export license.

(4) Foreign trade operators who export cerium and cerium alloys (particles < 500 microns), tungsten and tungsten alloys (particles < 500 microns), zirconium and beryllium are exempted from applying for export licenses, but they need to apply for the Export License for Dual-Use Items and Technologies in People’s Republic of China (PRC) as required.

(five) the goods in the catalogue provided by the Chinese government under foreign aid are not included in the export quota and license management.

Two, continue to suspend the state-owned trade management of lubricant (customs commodity number 27101991), lubricating grease (customs commodity number 27101992) and lubricant base oil (customs commodity number 27101993). Where a foreign trade operator exports the above-mentioned goods by general trade, he shall apply for an export license on the basis of the goods export contract. The export of the above-mentioned goods by other means of trade shall be implemented in accordance with the provisions of Announcement No.30, 2008 of the Ministry of Commerce, the Development and Reform Commission and the General Administration of Customs.

3. In order to implement the online verification of export licenses, the Ministry of Commerce or the local competent commercial departments entrusted by the Ministry of Commerce may, according to the management needs, endorse "non-batch and one license" in the remarks column of export licenses. The export license for goods made of "one batch and one license" can be used for customs clearance many times within the validity period, but not more than 12 times. If the export license has been cleared for more than 12 times, the customs will stop accepting customs declarations.

Goods that belong to the system of "one batch and one license" are: goods exported by processing trade; Goods exported under compensation trade; Wheat, corn, rice, wheat flour, corn flour, rice flour, live cattle, live pigs, live chickens, beef, pork, chicken, crude oil, refined oil, coal, motorcycles (including all-terrain vehicles) and their engines and frames, automobiles (including complete sets of spare parts) and their chassis.

The system of "one batch and one license" is implemented for the export of ozone-depleting substances, that is, the export license is used for customs declaration once within the validity period.

Four, in order to maintain the order of foreign trade, licorice, licorice products and natural sand (to Taiwan, Hong Kong and Macao) shall be declared and exported at designated ports. Among them, the customs declaration ports for licorice export are designated as Tianjin Customs, Shanghai Customs and Dalian Customs; The declaration ports for the export of licorice products are designated as Tianjin Customs and Shanghai Customs; The customs declaration port of natural sand export (to Taiwan, Hong Kong and Macao) is limited to the customs of the province (autonomous region or municipality directly under the Central Government) where the enterprise is located. Customs declaration and export of magnesia, rare earth, antimony and antimony products at designated ports will be suspended.

5. Entrusted by the Ministry of Commerce, the provincial local commercial authorities and the commercial authorities of Shenyang, Changchun, Harbin, Nanjing, Wuhan, Guangzhou, Chengdu, Xi ‘an and other sub-provincial cities implement the export license of goods according to the division of labor, and issue export licenses. The provincial local commerce authorities mentioned in this announcement refer to the commerce authorities of all provinces, autonomous regions, municipalities directly under the Central Government, cities with separate plans and Xinjiang Production and Construction Corps.

6. This announcement shall be implemented as of January 1, 2019. On December 22, 2017, the Catalogue of Goods Subject to Export License Administration in 2018 promulgated by the Ministry of Commerce and the General Administration of Customs was abolished at the same time.
